Overview

South Dakota voters approved medical cannabis in 2020 (Initiated Measure 26). The Department of Health certifies medical cannabis establishments and issues patient cards.

The state doesn't set a statewide cap. Instead, cities and counties decide whether to allow establishments and how many, and many issue their own local licenses. Securing local approval is usually the hardest step. Adult-use measures failed in 2022 and 2024.
