Overview

Illinois legalized adult-use cannabis through the Cannabis Regulation and Tax Act, effective January 1, 2020, adding to a medical program that began in 2014. Licensing is split between two agencies: the Department of Financial and Professional Regulation (IDFPR) for dispensaries and the Department of Agriculture (IDOA) for cultivation, processing and transport.

License counts are capped, and new licenses are released through announced application rounds, several of which have prioritized social equity applicants.

License Types

  • Adult-Use Dispensing Organization (IDFPR)
  • Cultivation Center: large-scale growing, capped statewide
  • Craft Grower: 5,000 to 14,000 sq. ft. of canopy
  • Infuser: makes edibles and other infused products
  • Transporter
  • Processor

Key Requirements

  • Registered business entity with background checks for principal officers
  • Proposed site that meets local zoning (municipalities can prohibit or restrict businesses)
  • Security, inventory, staffing and recordkeeping plans
