Florida Marijuana License
Florida allows medical marijuana only. Businesses operate as vertically integrated Medical Marijuana Treatment Centers (MMTCs) licensed by the Office of Medical Marijuana Use, with new licenses issued only in limited, competitive rounds.
Overview
Florida currently allows medical marijuana through a regulated program created by a 2016 constitutional amendment. Recreational (adult-use) cannabis is not legal; a 2024 ballot measure to legalize it did not reach the required 60% vote.
Every licensed business is a Medical Marijuana Treatment Center (MMTC), a vertically integrated operator that cultivates, processes, transports and dispenses its own products. The Florida Department of Health's Office of Medical Marijuana Use (OMMU) oversees licensing. Licenses are capped and released in occasional competitive application windows; the most recent general round, opened in April 2023, ended in late 2024 with 22 applicants selected out of 74.
License Types
- Medical Marijuana Treatment Center (MMTC): the only business license. Covers cultivation, processing, transport and retail dispensing under one license.
- Pigford / Black farmer license: a separate license category reserved for eligible applicants under state law.
Florida does not issue standalone dispensary, grow, or delivery licenses.
Key Requirements
- Registered business entity in Florida, with background screening for owners and managers
- Ability to run a vertically integrated, seed-to-sale operation with a Florida-licensed testing lab
- A performance bond (generally $5 million, reduced to $2 million once serving 1,000+ patients)
- Certified financial statements showing capacity to operate
- A medical director who is a licensed physician
- A diversity plan promoting minority and veteran participation
Fees
- Application fee: $146,000, non-refundable, under the December 2022 licensing rule
- Biennial renewal fee: set by OMMU based on program regulatory costs; historically above $1 million per license
- Performance bond: $5 million (or $2 million at 1,000+ patients)
Fees are set by rule and can change between rounds. Confirm current figures with OMMU before applying.
Application Process
- Watch for OMMU to announce a licensing window (published as a rule with deadlines).
- Prepare the full application: corporate structure, operations, security, cultivation and processing plans, financials and diversity plan.
- Submit during the window with the non-refundable application fee.
- OMMU scores applications competitively; the highest scorers are selected.
- Post the performance bond within 10 business days of selection, then complete inspections before operating.
Regulations
- Sales only to registered patients and caregivers holding a state ID card
- Smokable flower is permitted for patients; edibles are allowed under OMMU rules
- Seed-to-sale tracking and independent lab testing are mandatory
- Local governments can ban dispensaries within their borders but cannot restrict cultivation or processing facilities differently than pharmacies
