Overview

Georgia allows registered patients to possess medical cannabis. The 2019 Hope Act created the Georgia Access to Medical Cannabis Commission (GMCC) to license in-state producers and dispensaries, and the Department of Public Health runs the patient registry.

Senate Bill 220, which took effect on July 1, 2026, replaced the old 5% THC limit with a 12,000 mg THC possession limit, let patients 21 and older vaporize, and added qualifying conditions. Smoking and adult use remain illegal.

All six production licenses (two Class 1 and four Class 2) have been awarded. Producers can open dispensaries, and independent pharmacies can also be authorized to sell.

License Types

  • Class 1 production: up to 100,000 sq ft canopy (2 licenses, both awarded)
  • Class 2 production: up to 40,000 sq ft canopy (4 licenses, all awarded)
  • Dispensing license, held by producers
  • Independent pharmacies authorized by the Board of Pharmacy

Key Requirements

  • Production licenses are capped and all have been awarded
  • Product forms are set by law and GMCC rules; vaporizable products for patients 21+ were added on July 1, 2026, and smokable products remain banned
  • Seed-to-sale tracking and testing

Fees

  • Class 1: $25,000 application, $200,000 initial fee, $100,000 annual renewal
  • Class 2: $5,000 application, $100,000 initial fee, $50,000 annual renewal
  • Dispensing: $5,000 application; $15,000–$30,000 initial fee and $25,000–$40,000 annual renewal by county tier

Application Process

  1. Production licenses are full, so watch the GMCC for any legislative expansion.
  2. Existing producers can apply for dispensing licenses.
  3. Pharmacies can seek Board of Pharmacy authorization to dispense.
